4 Most Common Violations That Lead To Expat ARREST AND DEPORTATION

Introduction

In June 2026 the Bureau of Immigration arrested an Australian woman who had overstayed nine years while working at a Siargao hotel. Today we explore the most common violations that get expats arrested and blacklisted.

THE MOST COMMON OFFENSES

Overstaying leads the reports. A 34-year-old American was arrested in Naga City in June 2026. Another overstayer was found at a subdivision in Cainta, Rizal.

Working without a permit is next. A foreigner in Baguio was working as a chef on a tourist visa. In Siargao, a Lithuanian was managing a resort and delivering food without permits.

Running a business on a tourist visa is a third. A New Zealander and a Swiss national said they were investors. The BI said they ran daily operations.

The fourth is having no papers. One foreigner in Bohol could not present any immigration documents.

HOW THEY GET CAUGHT

Locals report you. City hall personnel supplied information in Naga City. Siargao raids followed reports from residents and business owners.

Local officials can act. Officials in Negros Oriental declared an Estonian vlogger persona non grata, which means officially unwelcome, before the BI arrested him in January 2026.

Officers will go undercover to nab you. They posed as customers at the Siargao resort, they surveilled the Baguio chef, and in Bohol they worked with local police to gather evidence before making the arrests.

A WARNING FOR THOSE WITH AN ESTABLISHED LIFE

Marriage helps, with no guarantee. A 2015 BI order replaces deportation with fees for foreigners with strong family ties who commit simple violations. Law-firm commentary says marriage does not by itself legalize an expired stay or cancel a deportation order, but it does reduce the odds of you being deported, if you pay all the fines and fees.

Relationships can turn. In a 2021 report, relatives of an estranged Filipina wife accused an American before his arrest for overstaying.

SUMMARY

Overstaying, working without a permit, running a business on a tourist visa, and having no papers lead the reports. Neighbors, business owners, and local officials supply the tips. Marriage helps, with no guarantee. Confirm current rules with the Bureau of Immigration or a Philippine immigration attorney.
